Garland is a judge at the DC Circuit Court of Appeals with an excellent reputation and was previously nominated by former President Obama’s Supreme Court. He is likely to be confirmed eventually.

But first, he will likely face a lot of questions from Republican senators during his confirmation hearing where he asks if he will stay out of the way for an ongoing investigation by the Justice Department into Hunter Biden’s business dealings.

“Americans deserve to know that this investigation will not be hindered in any way by the change of administrations, and the candidate of the Attorney General should make this clear,” a spokesman for Senate Judiciary Committee member Senator Chuck Grassley, R-Iowa, told Fox News. “So yes, you can expect Senator Grassley to ask about his role in this inquiry.”

“Judge Garland’s extensive legal experience makes him well placed to lead the Department of Justice, and I appreciated his commitment to keeping politics out of the Department of Justice. It is my primary criterion for who will be the next head of the Justice Department. As Attorney General,” Cornyn said. “Both sides should support a depoliticized judiciary, and that’s what I hope Judge Garland will deliver once it is confirmed.”
